Terms and Conditions of Sale
Article 1: General Provisions
These terms and conditions of sale are concluded between, on the one hand, SEIZEMEDIA SAS, 1 Chemin de la Mendillone (RCS Lyon: No. 929 728 814), hereinafter referred to as "R’art," and, on the other hand, any individual or legal entity making a purchase via the website "www.rartbooks.com," hereinafter referred to as "the Buyer."
1.a. Sales made via the "www.rartbooks.com" website (the "Site") are subject to the following general terms and conditions, to which the Buyer agrees without restriction or reservation.
1.b. These terms define the sale between the Buyer and Rartbooks, specifying the conditions of ordering, payment, delivery, and management of potential product returns.
1.c. The Buyer may freely consult these general terms and conditions of sale at any time by clicking on the "Terms and Conditions of Sale" link.
1.d. R’art may modify these general terms and conditions of sale. The applicable terms between the Buyer and R’art are those in effect on the Site at the time the order is placed.
Article 2: Orders
2.a. General Conditions for Placing an Order
The Buyer declares to be of legal age and capable, or to have authorization from a legal representative, to make a purchase on the Site.
2.b. Order Placement
Orders are placed exclusively via the Site. The Buyer selects the products, the payment method, and delivery terms, then validates the order.
Each step of the order process requires confirmation. The order can be canceled at any step upon the Buyer's request.
2.c. Order Confirmation Email
After payment, R’art sends the Buyer a confirmation email. It is recommended that the Buyer retains a copy.
Article 3: Products
3.a. Product Condition
R’art sells second-hand cultural items (Artist Catalogs, Coffee Table Books, Magazines/Fanzines), hereinafter referred to as "Products."
Due to their second-hand nature, Products may show previous use and wear marks.
Products are classified into four quality levels at R’art’s discretion: Like New, Very Good, Good, and Acceptable.
Like New/New: The product looks like a new book with no marks. The original dust jacket is present. The book may or may not be sealed in plastic.
Very Good Condition: Not to be confused with a new book, the product has only minimal, almost imperceptible defects. The spine may have a slight reading crease.
Good Condition: The product has minor visible aesthetic defects. The cover may have light creases, and the pages may show slight wear but are not dog-eared or yellowed.
Acceptable Condition: The product shows significant wear but remains functional.
By placing an order, the Buyer accepts R’art’s quality classification.
3.b. Product Information
R’art presents Products on the Site with essential details to inform the Buyer about their condition. The accompanying photographs and descriptions are non-contractual and do not engage R’art’s liability.
The Buyer is solely responsible for selecting and purchasing a Product.
3.c. Stock
Products are available while stocks last. If a Product becomes unavailable, R’art commits to refunding the Buyer in full as soon as possible.
Article 4: Prices
4.a. Product prices are displayed on the Site in Euros. At checkout, the total price including applicable French taxes is shown.
Prices do not include shipping fees, which are the Buyer’s responsibility unless otherwise stated in Article 6.b.
The Buyer is informed of shipping costs before finalizing the order. Payment includes both the product price and shipping fees.
4.b. By confirming payment, the Buyer agrees to the shipping fees. These fees cannot be used as a reason to dispute the order after finalization.
4.c. Orders shipped outside France may be subject to taxes or customs duties imposed upon arrival. These remain the Buyer’s responsibility.
Article 5: Payment
5.a. Payment is made exclusively via credit card through a secure payment provider.
The Buyer’s account is debited for the order’s total amount, including product and shipping costs.
5.b. All purchases must be paid in full at the time of ordering. No Product will be shipped until full payment is received.
5.c. R’art reserves the right to suspend or cancel an order if payment authorization is denied or if there is non-payment.
5.d. R’art may refuse orders from Buyers who have outstanding payments or ongoing disputes.
Article 6: Delivery
6.a. Products are deliverable worldwide to the address specified at checkout. Once validated, the delivery address cannot be changed. Upon shipment, R’art will notify the Buyer via email.
6.b. Delivery may take up to 30 business days within mainland France and Corsica, and up to 60 days for other locations.
6.c. Delivery times are estimates and delays do not warrant penalties, damages, or order cancellations.
6.d. Delivery is deemed complete upon the first presentation to the Buyer. The Buyer must verify the condition of the delivered Products upon receipt. Any delivery anomalies must be reported to the designated carrier.
If a received Product is incorrect or damaged due to delivery, the Buyer must contact R’art’s customer service within 48 hours. Depending on the situation, R’art may offer a refund, store credit, or reshipment of the Product (subject to availability), with return shipping costs at the Buyer’s expense.
Article 7: Right of Withdrawal
7.a. R’art sells Products "as is."
7.b. In compliance with applicable laws, the Buyer has a 14-day withdrawal period following delivery. Return costs are the Buyer’s responsibility.
7.c. R’art will refund the Buyer for returned Products within 30 days, provided they are returned in their original condition.
7.d. The Buyer assumes all return shipping costs and risks. No refund will be issued if R’art does not receive the returned Products.
Article 8: Retention of Ownership
Ownership of Products remains with R’art until full payment is received.
Article 9: Warranty - Liability
Products are sold "as is" and benefit from the legal warranty under Article 1641 of the French Civil Code. Any claims for hidden defects must be made in writing within 14 days of discovery.
Article 10: Website Access License
The Site and its content remain the exclusive property of R’art. The Buyer is granted a limited license for personal use only.
Article 11: Personal Data Protection
The Buyer’s personal information is necessary for order processing and may be shared with R’art’s contractual partners.
Article 12: Governing Law and Jurisdiction
These terms are governed by French law. Any disputes shall be submitted to French courts.
